Agreement to be bound by these Terms of Use

Your use of this website and any applications, software, data, products, competitions, prize draws, and any other services provided to you on, or from, or through the website by HUL  (collectively called the “Services”), is subject to the terms of a legal agreement between you and HUL.  In addition to the Terms of Use, the legal agreement is made up of (i) the Privacy Policy, and (ii) the Legal Notice, (iii) the  Moderation Guidelines and (iv) the Community Guidelines (collectively called the “Unilever Policies”).  To the extent of any conflict between the Terms of Use and any other Unilever Policies, the Terms of Use shall prevail.

Continuing Agreement

You agree that we may change or revise these Terms of Use from time to time by updating this posting, and that such changes or revision will take effect immediately upon our posting, so please visit this area each time you visit the website to keep up to date with the current Terms of Use. Your use of the website reaffirms your continuing agreement to the then-current Terms of Use.

Privacy

HUL takes your privacy very seriously and will use and protect any personal information you provide on this website in accordance with our Privacy Policy.

User Submissions

Certain portions of the website may invite or enable you to post, upload, embed, display or otherwise communicate text, messages, photos, videos, sound recordings, music (including lyrics), graphics, drawings, suggestions, ideas (including product and advertising ideas), your and/or other persons’ names, likenesses, voices, usernames, performances  and other information, materials or content owned or created by you (collectively, "User Submissions"). 

HUL WILL CONSIDER USER SUBMISSIONS AS NON-CONFIDENTIAL AND NON-PROPRIETARY AND SHALL BE UNDER NO OBLIGATION TO MAINTAIN THE CONFIDENTIALITY OF ANY INFORMATION CONTAINED IN YOUR USER SUBMISSION. 

If you wish to submit information that is the subject of an issued patent or a published pending patent application, then please go to the Innovation section of the Unilever website (http://www.unilever.com/innovation/collaborating/workingwithus/index.aspx). This is the appropriate forum for technical product and technology ideas relating to our products and brands.   If your User Submission is the subject of a pending or issued patent, you must disclose this fact to Unilever.

You warrant and represent that you have (and will continue to have during your use of the website) all necessary rights, licenses, consents and permissions which are required to enable HUL, Unilever Group companies and/or content providers to use your User Submissions for the purposes envisaged by the website and these Terms of Use.

You further warrant and represent that you have the consent, release, and/or permission of each and every identifiable individual in your User Submissions to use his or her name, username or likeness in the manner contemplated by the website and the Products, Services or other materials on or available from the website.

In connection with User Submissions, you agree and warrant that:

  1. you will not submit any User Submission that is subject to any right of a third party including, without limitation:
    1. copyright, patent, trade mark, trade secret, or other proprietary or contractual right;
    2. right of privacy or publicity; or
    3. confidential information

    unless you are the owner of such rights or have permission from the rightful owner(s) to submit the User Submission and to grant the rights herein;

  2. neither the User Submissions, nor the use of the User Submissions as permitted in these Terms of Use, will infringe upon or violate the rights of any person or entity or any applicable laws;
  3. you will not submit User Submissions that are unlawful for you to possess in the country in which you are resident, or which it would be unlawful for HUL to use or possess in connection with the provision of the website or the Services; and
  4. you will not submit a User Submission that:
    1. is illegal or encourages or condones illegal acts or the discussion of illegal acts with the intent to commit them, including drug dealing, drug abuse, child pornography, physical or sexual assault, stalking, theft, fraud or conspiracy to commit a criminal act;
    2. is defamatory, threatening, abusive, harassing or an invasion of privacy;
    3. is discriminatory or prejudicial based upon race, colour, religion, gender, sexual orientation, age, disability or otherwise;
    4. is obscene, pornographic or otherwise sexually explicit;
    5. is dangerous, irresponsible or antisocial or encourages or condones dangerous, irresponsible or antisocial behaviour;
    6. contains a virus, spyware or other harmful component, or otherwise impairs, interrupts or damages the website, the Services or any connected network, or otherwise interferes with a person’s use or enjoyment of the same; or
    7. contains any advertisement, solicitation, chain letter, pyramid scheme, investment opportunity or other unsolicited commercial communication.
  5. HUL has no obligation to use your User Submission in any way and HUL shall not be obliged to give reasons for rejecting your User Submission or to identify HUL activities that relate to your User Submission in any way;
  6. HUL has no obligation to compensate you for any use of your User Submission as envisaged by the website and these Terms of Use; and
  7. HUL may use your name to attribute your User Submission to you (although we shall not be obliged to do so).

You understand and agree that you are solely responsible for your own User Submissions and the consequences of your posting or publishing them.

In addition, you understand and agree that when using the website, you may be exposed to User Submissions posted and/or submitted by other users. HUL is not in any manner responsible for User Submissions, and HUL does not guarantee the accuracy, integrity, quality or intellectual property rights of, or relating to, such User Submissions. In addition, HUL cannot assure that harmful, inaccurate, deceptive, offensive, threatening, defamatory, unlawful or otherwise objectionable User Submissions will not appear on the website. 

Without limiting the generality of the foregoing, you acknowledge and agree that the information, materials and opinions expressed or included in any User Submissions are not necessarily those of HUL or its affiliated or related entities or content providers and HUL expressly disclaims any and all liability in connection with any User Submission.  You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against HUL with respect to any User Submissions.

By uploading User Submissions you understand that they may be available to the public and you agree not to assert in any part of the world any claim for invasion of privacy, breach of your rights under the Information Technology Act, 2000 and its allied Rules and Regulations or appropriation of your right of publicity arising from or out of HUL’s use of your User Submissions in accordance with these Terms of Use. 

Removal of User Submissions

Without prejudice to our other rights under these Terms of Use or at law, HUL reserves the right in its absolute discretion and without prior notice to refuse to post, exclude or remove any User Submission from the website that violates the Terms of Use and/or the Unilever Policies. 

Identifying Users and Disclosing User Submissions to Third Parties

HUL will fully cooperate with any law enforcement authorities, court order or subpoena requesting or directing HUL to disclose the identity of anyone posting User Submissions.  To the extent we can do so by law, we reserve the right to identify any user to third parties and/or disclose any User Submission or personal data to any third party claiming that a User Submission infringes their intellectual property rights or their right to privacy.  We may also disclose such information if we believe in good faith that such disclosure is reasonably necessary to protect the rights, property, or personal safety of HUL, its customers or the public.

Moderation

Although HUL is under no obligation to review or monitor User Submissions, HUL reserves the absolute right to do so in its sole discretion. In addition, HUL reserves the right at all times to alter, edit, refuse to post or remove any User Submissions from the website, in whole or in part, for any reason or for no reason and without prior notice. You agree that HUL does not have any obligation to use or respond to any User Submission.

If you upload User Submissions to the website, or make contact with other users of the website, you must comply with the Moderation Guidelines and Community Guidelines.

Ownership and Use of Website Materials, Products and Services

With the exception of User Submissions, HUL owns the intellectual property rights for all of the materials on the website or has a valid right from a third party to use materials on the website. Ownership of User Submissions

You shall retain all of your ownership rights in your User Submissions, but you are required to grant limited rights to HUL and other users of the website. 

In return for using the website and the Services, you grant HUL a non-exclusive, irrevocable, worldwide, transferable licence (with full right to sub-licence) to use your User Submissions for any purpose whatsoever (to the extent permitted by law) in perpetuity and free of charge.  The licence shall include, without limitation, the right to reproduce, copy, edit, adapt, make derivative works, combine with other works, make available, synchronise, display, publicly perform, transmit, broadcast, publish, distribute, sub-license and delete your User Submissions.  Without prejudice to the foregoing, if you hold a patent in your User Submission, HUL acknowledges that these Terms of Use shall not grant HUL any licence under any such patent.

You acknowledge and agree that if HUL edits, modifies or makes a derivative work from your User Submission, or combines your User Submission with other works, any rights in such modifications or derivative works shall be owned exclusively by HUL.

If your User Submission includes an idea or suggestion, you acknowledge that HUL, a Unilever Group company or a third party acting on its/their behalf may have previously worked on or may be working on the same or a similar idea.  By submitting your idea, you agree that we may continue to develop the idea (or a similar idea) independently of, and without acknowledging, your idea. 

You hereby irrevocably and unconditionally release and forever discharge HUL and Unilever Group companies from any and all actions, causes of actions, claims, damages, liabilities and demands, whether absolute or contingent, and of any nature whatsoever, which you may have or may in the future have against HUL and/or any Unilever Group company with respect to your User Submission, including how HUL and/or Unilever Group companies use your User Submission.

Licence to Other Users of the Website

You also grant to each user of the website, a non-exclusive, worldwide licence to access your User Submissions through the website free of charge, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions to the extent permitted by the functionality of the website and as envisaged by these Terms of Use.

Consents

You grant HUL all consents required pursuant to the Copyright Act, 1957 (and all other laws now or in future in force in any part of the world) which may be required for the use by HUL, Unilever Group companies and/or content providers of your User Submissions in accordance with these Terms of Use.

You waive all moral rights to which you may be entitled under any legislation now existing or in future enacted in any part of the world relating to your User Submissions.

Geographic Scope of the Website

HUL controls and operates this website from India. Unless otherwise specified on or by this website, this website is intended to promote only those HUL products that are sold by HUL, and HUL makes no representation that materials in this website or the Products described thereby are appropriate or available for use in other locations. Bru World Café Cappuccino Pay Back Offer Terms and Conditions

  1. Bru World Cafe (hereinafter referred to as 'BWC') offers one 1 Cappuccino Coffee (hereinafter referred to as 'Offer') which can be availed on the first pay back transaction made at any of the operational BWC outlets.
  2. Offer is valid from 2nd January, 2015 to 31st March, 2015 (hereinafter referred to as 'Offer Period')
  3. This is a onetime Offer and it cannot be availed twice at any given month during the Offer period.
  4. Offer shall be communicated to the Offeree through mail by Payback representatives
  5. The Offeree need to furnish the valid Payback number being provided to them through payback loyalty program/scheme in order to avail the Offer.
  6. Offer cannot be clubbed with any other promotions going on at the BWC outlets.
  7. The Offer cannot be exchanged or redeemed for cash.
  8. HUL shall not held responsible if wrong details are furnished or in the eventuality of communication mail not being sent or delivered to the Offeree for whatsoever reasons.
  9. HUL reserves the right to amend or withdraw the Offer at any time during the Offer period.
  10. The Offer given out shall be governed by the terms and conditions applicable to Offeree's payback loyalty program and HUL shall assume no responsibility or liability for their use.
  11. The Offer is valid only for 1 Cappuccino Coffee. Food and Beverage retail and merchandise items such as water bottle, sandwich, magnum etc are not included.
  12. All disputes shall be subject to the exclusive jurisdiction of courts of Mumbai in the first instance.

Mobile Recharge Offer T&C

Following are the terms and conditions for participation by consumers in the "BRU 200g FREE MOBILE RECHARGE OFFER campaign” brought to you by Hindustan Unilever Limited ("HUL"), for promotion of its brand Bru.

By entering the Competition and/or accepting any prize, all entrants and winners agree to be bound by the terms and conditions below.

Terms and Conditions

  1. The Campaign starts 12 Midnight IST on 21st June, 2014 and ends on 20th Aug, 2014 at 11:59 PM IST.
  2. These terms and conditions are applicable for the "BRU MOBILE RECHARGE OFFER" which will be applicable during the Campaign Period.
  3. The Campaign is open to callers who are users of pre-paid mobile phone connections located in Tamil Nadu, Andhra Pradesh, Karnataka & Kerala.
  4. To avail this offer and participate in the Campaign, a Consumer, upon purchasing Bru 200g poly must open the product bag, locate the unique code printed within, and give a missed-call to "08082800177”. By placing a missed-call, the Consumer expressly opts to participate in the Campaign and to receive a call back from HUL’s service provider. IVRS automated calls enable consumers to respond a call-back via voice input or keypad selection.
  5. Upon receiving a call-back, the Consumer will be requested to follow instructions for (a) entering the unique product code and (b) participating in a brief Consumer survey. Upon completion of the Consumer survey, and depending on the product purchased, the Consumer will be awarded a mobile recharge of Rs.50.
  6. Mobile recharge will be confirmed via SMS confirmation to the Consumer. Each unique product code is valid for one Campaign entry only. Please note, post-paid mobile phones are not eligible for mobile recharge during this offer.
  7. This Campaign is open for customers of ALL Telecom operators (subject to network availability).
  8. In respect of each unique Bru Product code, after the re-charge is completed, HUL shall have no further airtime reward obligations to the participating Consumer.
  9. Sending an SMS/ missed call to participate in the Campaign would be construed to be opting in to receiving commercial communications in future from HUL and that this term would override any registration that the Consumer may have on the NCPR to not receive such communications.
  10. Participation in this Campaign is free, voluntary and at the sole discretion of the Consumer. By participating in this Campaign, the consumer fully and unconditionally agrees to and accepts these Terms and Conditions as well as the decisions of HUL which are final and binding in all matters related to the Campaign.
  11. HUL cannot guarantee connectivity via the mobile network of the telecoms service provider subscribed to by the consumer. Accordingly, HUL shall not be responsible or liable for any inability of, or failure by, the Consumer to connect to any of the above mobile recharge telephone numbers.
  12. Inability to connect to mobile recharge telephone numbers may be due to various reasons including but not limited to network congestion, consumer being outside coverage area, network unavailability, third party dependency, or entering an incorrect code, etc.
  13. HUL shall not be responsible for misdirected calls or loss of calls while entering the response during the IVRS call. Proof of calling is not proof of receipt of the call.
  14. The IVRS instruction shall be in respective local language of various telecom circles where campaign is being run & in English. Consumers will be requested to select a language option.
  15. HUL reserves the right to alter, modify or change any terms and conditions herein or modify/change, discontinue, terminate, withdraw the Campaign at any time during the Campaign Period at its sole discretion without prior notice or assigning any reason.
  16. During the Campaign Period, Consumers may participate multiple times in the Campaign i.e. each time the Consumer purchases Bru Products. However, maximum valid campaign entries are limited to only 2 per day, 4 in the week & 8 for the entire campaign per Consumer. In case of invalid code entry, maximum number of invalid entries allowed per consumer, having 3 attempts per entry is 12 in entire campaign period. Thus total of 12 attempts per consumer are allowed for invalid entry code input for entire campaign period.
  17. HUL, their service provider and their affiliated partners may contact Campaign participating Consumers regarding other products in the future.
  18. This offer is applicable across all telecom providers operating in the state of Andhra Pradesh, Kerala, Tamil Nadu & Karnataka.
  19. The Campaign is applicable only for consumers with pre-paid mobile numbers in above states
  20. Post 20th Aug, 2014, users with valid codes on Bru Coffee packs will be able to redeem alternative rewards at the discretion of HUL.
  21. In case of any issues, consumers can call the HUL toll free no. 18001022221 (Lever-care)
  22. Airtime rewards cannot be exchanged for cash and are not transferable.
  23. HUL does not accept responsibility for entries lost, corrupted or delayed as a result of any network, hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
  24. No entries from agents, third parties, organised groups or applications automatically generated by computer will be accepted.
  25. The decision of HUL shall be final and binding regarding this Promotion and offer.

The time required for credit of talk-time for all non-Mobile number portability (MNP) requests received from mobile numbers of participating telecom operators will be 24 hrs post receipt of such request from the customer. Time Taken for credit of talk-time for all Mobile Number which have Ported cases (customer has ported out of the original service provider's network) will be 24 hrs from the date of receipt of the request, provided the new telecom operator is part of the participating telecom operator.
  30. HUL shall not be responsible for downtime on services rendered by the Telecom operators / provider that may occur for any reason whatsoever including without limitation due to decisions and / or changes in regulations that are carried out by TRAI, DoT or any other regulatory body.
  31. HUL or its Technology Partner shall not be liable for any loss or damage due to act of God, governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any other such loss.
  32. HUL or its Technology Partner shall not be liable for any loss of offer due to incorrect mobile number of user or any other information provided by the user.
  33. HUL reserves the right to alter, modify or change any terms and conditions herein or modify/change, discontinue, terminate, withdraw the campaign at any time during the Campaign Period at its sole discretion without prior notice or assigning any reason.
  34. All disputes with respect to this Campaign are subject to the exclusive jurisdiction of the Courts or forums in Mumbai only.

Talktime Offer T&C

Following are the terms and conditions for participation by Bru Retailers in the "BRU Rs. 10 Free Talktime Offer campaign” brought to you by Hindustan Unilever Limited ("HUL"), for promotion of its brand Bru.

By entering the Competition and/or accepting any prize, all entrants and winners agree to be bound by the terms and conditions below.

Terms and Conditions

  1. The Campaign starts 12 Midnight IST on 16th June, 2014 and ends on 20th Sept, 2014 at 11:59 PM IST.
  2. These terms and conditions are applicable for the "BRU MOBILE RECHARGE OFFER" which will be applicable during the Campaign Period.
  3. The Campaign is open to retailers who are users of pre-paid mobile phone connections located in States of Tamil Nadu, Andhra Pradesh, Karnataka & Kerala on direct purchases from HUL distributors.
  4. To avail this offer and participate in the Campaign, a Customer, upon purchasing a 36 unit bundle of Bru Instant Rs. 10 will be given a scratch card. The Customer will have to scratch the coupon and give a missed call on the number provided on the coupon. By placing a missed-call, the Customer expressly opts to participate in the Campaign and to receive a call back from HUL’s service provider. IVRS automated calls enable Customers to respond a call-back via keypad selection.
  5. Upon receiving a call-back, the Customer will be requested to follow instructions for entering the unique product code. Upon completion of the process, the Customer will be awarded a mobile recharge of Rs.10
  6. Mobile recharge will be confirmed via SMS confirmation to the Customer. Each unique product code is valid for one Campaign entry only. Please note, post-paid mobile phones are not eligible for mobile recharge during this offer.
  7. This Campaign is open for customers of ALL Telecom operators (subject to network availability).
  8. In respect of each unique Bru Product code, after the re-charge is completed, HUL shall have no further airtime reward obligations to the participating Customer.
  9. HUL cannot guarantee connectivity via the mobile network of the telecoms service provider subscribed to by the Customer. Accordingly, HUL shall not be responsible or liable for any inability of, or failure by, the Customer to connect to any of the above mobile recharge telephone numbers.
  10. HUL shall not be responsible for misdirected calls or loss of calls while entering the response during the IVRS call. Proof of calling is not proof of receipt of the call.
  11. HUL reserves the right to alter, modify or change any terms and conditions herein or modify/change, discontinue, terminate, withdraw the Campaign at any time during the Campaign Period at its sole discretion without prior notice or assigning any reason.
  12. During the Campaign Period, Customers may participate multiple times in the Campaign i.e. each time the Customer purchases Bru Products. However, maximum valid campaign entries are limited to only 2 per day, 4 in the week & 8 for the entire campaign per Customer. In case of invalid code entry, maximum number of invalid entries allowed per Customer, having 3 attempts per entry is 12 in entire campaign period. Thus total of 12 attempts per Customer are allowed for invalid entry code input for entire campaign period.

  14. Airtime rewards cannot be exchanged for cash and are not transferable.
  15. HUL does not accept responsibility for entries lost, corrupted or delayed as a result of any network, hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
  16. No entries from agents, third parties, organised groups or applications automatically generated by computer will be accepted.
  17. The decision of HUL shall be final and binding regarding this Promotion and offer.
